These Terms and Conditions (“Terms”) govern your access to and use of the website https://communityray.com/ (“the Site”) and any related services, content, tools, and communications offered by Community Ray (“Community Ray,” “we,” “us,” or “our”) (collectively, the “Services”).
Please read these Terms carefully. By accessing the Site, submitting an enrollment or contact form, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with these Terms, please do not use the Services.
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Services. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.
Enrollment in a community solar Program also requires that you have an active electricity account with a participating Utility, that your service address is located within a qualifying service territory, and that you meet any additional eligibility criteria set by the Program, the Solar Farm owner, the Utility, or applicable state regulations. Program availability is limited and subject to Solar Farm capacity.
Community Ray connects households and businesses with local Solar Farms, and supports Solar Farm owners and energy providers with customer acquisition, enrollment, management, and retention services.
Community Ray is not a utility, an electricity provider, a retail energy supplier, or a generator of electricity. We do not produce, deliver, or sell electricity, we do not own the Solar Farms, and we do not issue your utility bill or apply Bill Credits to it. Your electricity service continues to be provided by your Utility, and your participation in a Program is subject to the terms of the subscription agreement between you and the applicable Solar Farm owner or Program administrator (the “Subscription Agreement”).
In the event of a conflict between these Terms and your Subscription Agreement with respect to your participation in a Program, the Subscription Agreement controls.
When you submit an enrollment request or contact form, you agree to provide accurate and complete information, including your name, service address, contact details, and, where required by the Program, your Utility account information and a copy of a recent utility bill.
You authorize Community Ray and the applicable Program administrator to use this information to verify your eligibility, to obtain your electricity usage history from your Utility where permitted, and to complete your enrollment. Submitting an enrollment request does not guarantee acceptance. Enrollment is confirmed only after the Program administrator and, where applicable, the Utility approve your subscription.
You are responsible for keeping your information current and for notifying us of any change to your service address, Utility account, or contact details.
Any savings figures presented on the Site or in our communications, including references to savings of up to 15%, are estimates based on Program terms, historical Solar Farm output, and typical household usage. They are illustrative only and are not a guarantee, promise, or warranty of any particular result.
Actual savings and Bill Credits depend on factors outside our control, including your electricity consumption, Utility rates and rate changes, weather and seasonal Solar Farm production, Program allocation rules, regulatory changes, and the terms of your Subscription Agreement. In some billing periods, credits may be lower than expected or may not be applied at all.
You remain responsible for paying your Utility bill in full and on time, as well as any amounts owed to the Program administrator under your Subscription Agreement.
Community Ray does not charge Subscribers a fee for using the Site or for facilitating enrollment. Billing for a community solar subscription is handled by your Utility, the Solar Farm owner, or the Program administrator in accordance with your Subscription Agreement, which sets out subscription charges, credit rates, billing cycles, and payment methods.
Any questions or disputes about charges, credits, or payments should be directed to the party identified in your Subscription Agreement, and to your Utility for questions about your electricity bill.
Cancellation rights, notice periods, and any applicable fees are governed by your Subscription Agreement and by the rules of the Program and your state. Many Programs allow cancellation without penalty upon advance written notice.
If you move within the same Utility service territory and remain eligible, your subscription may be transferred to your new address, subject to Program approval and available capacity. If you move outside the service territory or otherwise become ineligible, you may cancel your subscription in accordance with your Subscription Agreement.
Please notify us or your Program administrator as soon as possible before a move so that your subscription can be transferred or closed correctly.
By providing your telephone number, email address, or other contact information, you consent to receive communications from Community Ray and our authorized partners regarding your inquiry, enrollment, subscription, and related services. These communications may include calls, text messages, emails, and prerecorded or autodialed messages sent to the number you provide, even if that number is registered on a state or federal do-not-call list.
Consent to receive marketing communications is not a condition of enrolling in a community solar Program or of purchasing any goods or services. Message and data rates may apply, and message frequency varies. You may opt out of marketing text messages at any time by replying STOP, unsubscribe from marketing emails using the link in the message, or contact us at info@communityray.com. We may continue to send you non-marketing transactional messages about your account or subscription.
By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from Community Ray. This includes SMS messages for conversations, including messages sent by our employees on our behalf. Opting in is optional and is not a condition of enrolling in a Program or of purchasing any goods or services.
Message frequency varies. Message and data rates may apply according to the plan you hold with your wireless carrier. Message HELP for help. Reply STOP to any message to opt out; we will send one confirmation message and then stop sending marketing texts to that number. Wireless carriers are not liable for delayed or undelivered messages.
Community Ray values the privacy of your communication and is committed to safeguarding your SMS contact and content data. We do not sell or share SMS contact or content data with third parties.
Our collection and use of your information is described in our Privacy Policy, including the SMS provisions in Section 18 of that policy.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree that you will not:
We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms.
If you are provided with login credentials for any portion of the Services, you are responsible for maintaining the confidentiality of those credentials and for all activity that occurs under your account. You agree to notify us immediately at info@communityray.com if you suspect any unauthorized use of your account.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Site without our prior written permission. The Community Ray name and logo are our trademarks and may not be used without our prior written consent.
The Site may contain links to third-party websites and may reference Solar Farms, Program administrators, Utilities, and other third-party providers. We do not control and are not responsible for the content, products, services, privacy practices, or acts and omissions of any third party.
Your dealings with any third party, including any Program administrator or Solar Farm owner, are solely between you and that third party. Links are provided for convenience and do not imply our endorsement.
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Community Ray disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content, estimate, or savings projection presented through the Services. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
To the fullest extent permitted by law, Community Ray and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, savings, goodwill, or business opportunity, arising out of or related to your use of the Services or your participation in any Program, whether based in contract, tort, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Services will not exceed one hundred U.S. dollars ($100.00). Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of these limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Community Ray and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, your violation of these Terms, your violation of any applicable law, or your infringement of the rights of any third party.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
We encourage you to contact us first at info@communityray.com so that we can try to resolve any concern informally. If we cannot resolve a dispute within sixty (60) days of your written notice, you and Community Ray agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
Arbitration will take place in Collin County, Texas, or another mutually agreed location, or may be conducted remotely where the rules permit. You and Community Ray agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims of more than one person. You and Community Ray waive any right to a jury trial.
If any part of this Section 16 is found unenforceable, that part will be severed and the remainder will continue to apply, except that if the class-action waiver is found unenforceable, this entire Section 16 will be void.
These Terms and any dispute arising out of them are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Subject to Section 16, you agree that the state and federal courts located in Collin County, Texas will have exclusive jurisdiction over any dispute not subject to arbitration. Nothing in these Terms limits any rights you may have under the consumer protection laws of your state of residence.
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including a breach of these Terms. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law survive any termination.
We may update these Terms from time to time to reflect changes in our Services, our business practices, or applicable law. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the Services after the updated Terms are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy and any applicable Subscription Agreement, constitute the entire agreement between you and Community Ray regarding the Services.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of nature, severe weather, utility or grid outages, labor disputes, regulatory action, or failures of third-party systems.
